DMCA Policy

Search Advisor respects the intellectual property rights of others. We expect our users and content contributors to do the same. This policy outlines our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”).

Reporting Copyright Infringement: DMCA Takedown Notices

If you believe content on Search Advisor infringes your copyright, please send a DMCA notice to our Designated Copyright Agent. A valid notice must include all of the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works. Our articles discussing investment advisors are original content.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Providing URLs is helpful.
  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and email address.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receiving a valid DMCA notice, Search Advisor will promptly remove or disable access to the allegedly infringing material. We will also notify the user who posted the material about the claim.

Counter-Notification Process

If your content was removed due to a DMCA notice and you believe it was removed in error or that you have the right to use it, you may submit a counter-notification. This is your statement disputing the claim of infringement.

A valid counter-notification must contain the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Search Advisor may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Once we receive a valid counter-notification, we will send a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, within 10 to 14 business days after receipt of the counter-notification.

Repeat Infringer Policy

Search Advisor maintains a policy of terminating, in appropriate circumstances, users who are repeat infringers of copyright. We reserve the right to remove content and terminate accounts of users who repeatedly post infringing material. This policy applies to all content, including articles about financial and investment advisors.
